Don’t Forget the Marriage License: Your Marriage Isn’t Legal Without It

It happens!

The couple shows up. The guests are seated. The officiant is ready. But the marriage license? Nowhere to be found.

Some left it at home. Others never got one at all. And some assume it can be obtained later.

But here’s the truth: without a valid DC marriage license in hand, your marriage isn’t legally binding—no matter how beautiful the vows or how heartfelt the ceremony.

 

The Law Is Clear

To get married in Washington DC, Maryland, and Virginia, you must obtain your marriage license before the ceremony.

In DC, the license must be issued by the Marriage Bureau of the DC Superior Court. There is no waiting period, and DC’s Marriage Bureau is known for being relatively quick and efficient when you apply in person. Applying online is different. You will need to babysit your application until the certificate is in your hands.

No matter what, it is your responsibility to apply for your marriage license, bring the package from the court with you, and give it to your officiant before the start of your event.

Your officiant—whether religious or civil—cannot legally pronounce you married unless that license is present.

 

Can’t You Sign It Later?

Couples will ask, “Can you just sign it after?” The short answer is: it depends.

  • Officiant’s availability to sign the license at a later date.
  • The physical location where the marriage license must be used may be too far for a return visit.
  • If your officiant isn’t conveniently located near the venue, that could incur an additional service and fee. Or, you’ll be getting married at the courthouse in that jurisdiction.

 

What Happens If You Forget?

Life happens. Travel can be hectic. Maybe you’re coming from out of state or juggling dozens of details.

Have a Phone Copy

  • I tell all couples to send me a copy of their marriage certificate just to avoid not having the physical one.
  • Take a picture of it and have a copy in your phone. This is proof that you have a marriage license from the court where your ceremony will be officiated.

In those instances, I officiate the ceremony designed for the couple’s marriage.

 

No Copy or Marriage Certificate?

Otherwise, I offer couples an immediate alternative: a commitment ceremony. It looks and feels like a wedding, but legally, it’s a symbolic union.

I revise their ceremony on the spot to reflect this—removing words like “husband,” “wife,” and any reference to marriage.
And the couple has to make adjustments too—in their vows.

 

Avoid the Heartbreak

You don’t want to explain to your family later why your marriage certificate couldn’t be filed. You don’t want to deal with delays, rescheduling, or frustration.

That’s why I always remind couples:

✅ Apply for your license in advance
✅ Send the officiant a copy, and keep a copy for quick proof in your phone
✅ Bring the complete license package on the wedding day
✅ Hand it directly to your officiant
